Seller Agreement

• You must complete our seller application and pass identity verification before listing items.
• You must provide accurate personal, contact, and business information and keep it current.
• Trade documents you obtain later (e.g. a gem dealer licence or Business Registration) are reviewed by our team before any verified badge appears on your store.
• We may request additional documentation at any time to maintain verification.

• You must accurately describe each item, including origin, treatments, weight, measurements, and certification where applicable.
• Images must be of the actual item you are selling and must not be misleading.
• You warrant that you own, or are authorised to sell, every item you list.
• Counterfeit, synthetic-as-natural, or misrepresented items are strictly prohibited.

• Ishq Gems charges a platform fee on successful sales, as set by your membership plan and communicated in your dashboard.
• Payouts are made to the payout method you configure in Settings, subject to the platform's payout schedule and thresholds.
• Payment processing and currency-conversion fees may apply and will be disclosed.
• You are responsible for all taxes arising from your sales.
• We may withhold payouts during dispute resolution or suspected policy violations.

Fulfillment workflows depend on your membership plan tier:

• Intermediary Model (Free Tier Sellers): Free Tier sellers are strictly prohibited from shipping directly to buyers. All transactions must be fulfilled through the Ishq Gems intermediary logistics model. The seller must arrange to either drop off the item at the designated Ishq Gems Collection Hub in Colombo or request an authorized pickup.
• Direct Shipping (Paid/Premium Tier Sellers): Sellers on premium plans may choose to ship directly to buyers, subject to using approved insured carriers with real-time tracking.

Key Compliance & Handling Obligations:

• Fulfillment Deadlines: You must ship, drop off, or schedule a pickup for accepted orders within your configured processing time limit.
• Packaging Integrity: Sellers must ensure high-value items are packed securely in tamper-evident materials prior to handover.
• Chain-of-Custody Verification: Upon receipt of the item at the Ishq Gems hub, our team will perform high-resolution photographic and video recording of the item to document its condition. By utilizing this service, you agree to accept our intake inspection report as the definitive record of the item's condition at handover.
• Transfer of Liability: Sellers retain all risk of loss, damage, or theft until the item is officially received, verified, and signed for at the Ishq Gems Collection Hub. Upon verification, risk transfers to Ishq Gems, subject to our Liability Policy and Insurance Policy, until delivered to the buyer.
• Export & Customs Compliance: For international orders under the intermediary model, Ishq Gems will prepare and submit export declarations and customs documents. The seller is required to cooperate fully and supply all necessary certificate authentications, origin details, and transaction receipts.

• You must hold all licences and permits required for your business and for the items you sell.
• You must comply with all applicable laws, including those on ethical sourcing and anti-money-laundering.
• You must not engage in fraudulent, deceptive, or review-manipulating behaviour.

Buyer reviews and your reputation (Brilliance, Clarity, Facets, and Cut Tier) are earned through genuine activity. Attempting to manipulate reviews or ratings may result in penalties, loss of facets, or suspension.

We may suspend or terminate your seller privileges if you:

• Violate this Agreement, our Terms of Service, or applicable law;
• Misrepresent items or provide false information;
• Fail to fulfil orders or repeatedly receive serious disputes;
• Engage in fraudulent or harmful activity.

You may close your seller account at any time from Settings → Account Management. Outstanding orders and obligations survive termination.

This Agreement is governed by the laws of Sri Lanka, with exclusive jurisdiction in its courts, consistent with our Terms of Service.
